lure-patntent自分の祖父は沢山の特許を申請していた。内容は積荷の運搬時に置ける落下防止策案だった。結局は全部却下されていたが… 特許(パテント)というのは発明者に対して登録権を発生させて、第三者が使用した場合には使用料が発生するらしい。欧米には特許屋(特許トロール、特許クリフ)というのがいるらしい。これは大企業などを相手にこれらの行使権を合法的に悪用して使用料を迫る団体らしい。


チャターベイトの特許とは何か?

自分も知らなかった事だが…チャターベイトには特許が存在しているらしい。元祖のチャターベイトは Z-Man社やRad Lures社のチャターベイト。(国内では量販店に300円位で売られている)[pic]これらの会社がチャターベイトのパテントを保持しているらしい。そして、先週の7月11日にペンシルベニアに拠点を置くPicasso(ピカソ)ルアーが訴えられるnorたらしい。(米の記事には特許付与=Grantedと記載)このピカソ社はアーロンマーティンスをサポートするアウトドアの会社。去年はアーロンがB.A.S.S.で年間チャンピオンになった事で一躍注目される会社となった。[記事] アメリカでは一発当たるとラバージグでさえ初回6000万円位(cal:bc480円x125,000個)のオーダーが入るらしい。今回はピカソ社のチャターベイトがジャクポッドだったらしい。つまり、Zマン社が一発あてたピカソ社に噛み付いたという事になる。


米国特許取得番号:D760,866 Sによると出願名「フィッシングルアー・アタッチメントクリップ」趣旨説明は「チャターベイトのブレードにこのクリップを使用する事によりラインが絡まり難く一定層をしっかりと引ける。故に魚がより釣れる」つまりブレードにスナップを使用すると特許使用料が発生するらしい。(写真はピカソ社の”Shock Blade”シリーズ) 簡単な事だがリングにすると絡まってしまう。同時にこのパテントの件は米国のブレードジグマーケットので論争になっているようだ。このパテント権を発生させなければもっといいブレードジグが世に出ているであろうという事だけに過ぎないと思う。私はこれらの事に専門的な知識がないのでここで終わりにさせてもらう。


To get around the Z Man Patent other manufacturers use a simple split ring to attach the blade to the head. The problem with using the split ring approach is the connection is too loose and upon anything other than a slow retrieve the lure rises to the surface and also creates “blow out” causing the blade to bind to one side, stop vibrating and spin. ysxVxmJh問題がややこしくなったのは今から約10年前程前さ。Zマンは少しも努力はしていない会社。例えばゲーリーのヤマセンコー。一番、真似されるワームさ。世界中の会社が真似して発売してる。でもゲーリーさんは文句は言わない。そしてケイテックのスイングインパクト。スイングインパクトはここ2.3年で世界で一番真似されたワームさ。メガバスの110もね。いくつかの会社はそれなりのオリジナリティーを詰めこんでルアーを販売している。あのBoyd Duckettのルアー会社なんか酷いもんさ。まんまるモノマネだしね。[pic]リビングストンも同じさ。リビングストンの新しいジョインテッドベイトはガンクラフトのジョイクロをもろ真似だよ。[pic]今日のフィッシング業界はトゥーマッチさ。車業界と同じくね。全部同じ車に見えるよ。

Specifically D&M and Phenix. D&M’s bladed jig was really, really good and ZMAN basically copied it when they came out with their Project Z chatterbait(minus the clip where the line tie is).

Since they have that patent, then yeah they should protect it. The problem I have is that they do that BUT then they still go out and practically COPY other bait company’s most popular baits with very small changes. For example. Look at the Senko. Practically EVERY bait company on the planet has copied that bait. Not just the major guys. I’m talking about bait companies you’ve never even heard of copied it. The Keitech swimg impact fat has been the most copied bait in the past few years as well. Megabass vision 110 as well. Certain companies just have that reputation. Look at the Boyd Duckett series of baits. All literal copies of other really popular baits. Livingston as well. Livingston changes the designs a little bit, adds that EBS and pretends like they never copied anything. Livingston’s new swimbait is almost an exact copy of the Gan Craft Jointed Claw. It just goes on way too much in the fishing industry. Look at the car industry, same thing. All cars started looking alike and very similar to each other years ago.
